Ezekiel Machogu vs KTDA is a long-lived lawsuit turned political weaponry in the recently concluded August polls. The case continues to tear down the Education CS as a highly controversial man – scrapping HELB loans notwithstanding.

The legacy of Machogu dates back to the 80s when he first joined public service. At first a District Officer, he became a District Commissioner and eventually a legislator upon retirement.

The former Member of Parliament in Nyaribari Masaba Constituency is yet to set the record straight on the alleged embezzlement of funds at the Kenya Tea Development Agency (KTDA). Even so, his name and trading company are implicated.

Rival Kisii politicians are on record for accusing Machogu of gross misappropriations at KTDA.

Civil Suit 129 of 2014 filed at the Milimani Law Courts and published on the Kenyalaw.org website mentions Machogu as one of the main complainants.

The CS and his allies reportedly dragged KTDA to the court of law following a series of misunderstandings.

Thrown out by fellow auctioneers, Machogu successfully sued KTDA and was awarded Ksh. 165 million for damages.

In a video uploaded on the now-defunct Fred Amisi Live, Arati’s right-hand man is captured accusing Machogu of frustrating KTDA operations in Kisii County.

The official speaking in the local Ekegusii language is heard insisting that Machogu caused a burdensome 1.2 billion loan because of corrupt dealings through his tea auctioneer company, CWI.

Then, aspirant governor, Simba Arati went on to echo the message stating that tea farmers are innocently in the process of paying the said 1.2 billion loan.

Meanwhile, CS Ezekiel Machogu is yet to accept or deny these heated allegations.

Speaking during the Kisii County Gubernatorial Debate held live at Kamel Park, Machogu confirmed his membership in a 4-executive tea auctioneer called Savings Tea Brokers.

The CS intimated that his company was a tea broker from regions such as Rwanda, Uganda, Rift Valley, and Meru among others.

“Machogu did not steal from anyone while trading tea between 2001 and 2009. It is one of the directors who brought in the chaos resulting in the unlawful termination of the contract between Savings Tea Brokers and KTDA.”

The education CS went on to deny claims that he sold tea sourced from Kiamokama and Rianyanwamu zones.

He also clarified that his company was reimbursed Ksh. 55 million as opposed to Ksh. 165 million.

Ezekiel Machogu vs KTDA remains an open case without sufficient evidence on various corruption claims tainting his reputation.
